We (KLOTZ Immobilien | Bau GmbH) take the protection of your personal data extremely seriously. We treat your personal data confidentially and comply with the Bundesgesetz über den Datenschutz (Swiss Federal Act on Data Protection – DSG) and the related Datenschutzverordnung (Data Protection Ordinance – DSV). This privacy policy explains which data we collect and what we use it for. It also explains how and for what purpose this occurs.

2 DATA PROCESSING ACTIVITIES
The sections below explain our data processing activities.
2.1 DATA PROCESSING WITHIN THE SCOPE OF OUR SERVICES
If you use our services (e.g. real estate sale or rental, property management, holding of condominium owner meetings, real estate consultancy etc.), we will process your contact data, such as your surname, first name, address, e-mail address, telephone number and account details, as well as any data you provide us within this context (e.g. details of the property, photos, videos of the property etc.). You can provide us with this data by telephone, on site or by logging in online. We process this data for the following purposes:
– To handle the sale or rental of properties
– To value real estate and for real estate consultancy purposes
– To manage real estate
– To fulfil and implement contractual or legal obligations
– To provide information about properties of interest
– To combat fraud and abuse
– To develop and foster customer relations
– To improve offers
– To analyse user behaviour
2.2 STWEG Login
Registration is required to obtain a STWEG login. The login enables you to vote directly, in particular during assemblies, and to obtain documents such as your invoices or minutes. Certain personal data must be input to this end. The data is used for the purpose of providing our services and the related administration work.
2.3 PROPERTY SEARCH FORM
You can also register electronically via our website in order to obtain support with your property search. Your contact details and the property-related preferences that you share with us will be processed. This occurs for the purpose of finding a property and, where necessary, initiating and concluding an associated agreement.
2.4 Cookies
Our website uses cookies. Cookies do not damage your computer and do not contain viruses. Cookies are used to make our services more user friendly, effective and secure. Cookies are small text files that are stored on your computer and saved by your browser.
Most of the cookies we use are session cookies. They are deleted automatically at the end of your visit. Other cookies remain stored on your device until you delete them. These cookies enable us to recognise your browser the next time you visit us.

2.5 SERVER LOG FILES
The page provider automatically collects and stores information in server log files, which your browser automatically transmits to us to enable us to optimise the website and display it without technical issues. This information is as follows:

The data is deleted as soon as it is no longer required to achieve the purpose for which it was collected (e.g. once the session has ended if the data is required to provide the website).
2.6 E-MAIL CONTACT
If you contact us directly by e-mail, we shall exclusively process the data that you provide (e-mail address, surname, first name and any other personal data) for the purpose of dealing with your enquiry and your contact with us.
Please note that data transmission over the internet (e.g. e-mail communication) may be subject to security vulnerabilities. It is not possible to completely protect data against third-party access.
Your data will be deleted as soon as it is no longer required to respond to the enquiry unless legal retention obligations exist.
2.7 ENQUIRY FORMS
If you are interested in a specific property listing, you can submit an enquiry to us by means of a form. The input screen shows which personal data is transmitted to us during the enquiry. Your data may be manually recorded in the software of a third-party provider or imported via an interface. Based on the stored data, we can contact you in relation to other properties that meet the criteria established in your enquiry. Relevant property listings can be identified manually or automatically using software. We can inform you about such property listings by e-mail, letter or telephone. You are entitled to unsubscribe from this service at any time.
2.8 CREATION OF A PROPERTY SEARCH PROFILE
Our website offers users the opportunity to complete a form in order to store a property search profile. A property search profile tells us your preferences with regard to your property search. The input screen used shows which personal data is transmitted to us when storing a form.
The personal data collected in order to create a property search profile shall only be used to send you information about suitable property listings. The data transmitted may be manually recorded in the software of a third-party provider or imported via an interface. If properties are found that match the search criteria, we can notify you of these by e-mail, letter or telephone. We can also contact you at regular intervals to ask you to update your personal data in the property search profile. You can temporarily deactivate or completely delete the property search profile at any time.
You have the right to object to the processing at any time. In such an event, the conversation cannot be continued.
3 USE FOR ADVERTISING PURPOSES
KLOTZ Immobilien | Bau GmbH processes personal data for marketing activities such as sending e-mails with general information about new properties if you have requested this. You can object to this at any time by sending us an e-mail or other form of written correspondence.
3.1 Google Maps
Our website uses Google Maps (API) from Google Inc. (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; Google Limited Ireland, ‘Google’, is responsible for Europe). Google Maps is a web service for displaying interactive maps in order to visually present geographical information. By using this service, you will be shown our location to make it easier to get to us. When you call up subpages that Google Maps is integrated into, information about your use of our website (e.g. your IP address) is transmitted to Google servers in the USA, where it is saved. This occurs regardless of whether Google provides a user account that you are logged into or there is no user account. If you are logged into Google, your data will be directly assigned to your account. If you do not wish your data to be assigned to your Google profile, you must log out of this before activating the button. Google stores your data (including for users who are not logged in) in the form of usage profiles and analyses it.
4 Social Media
Our website uses links to various social networks. These are listed below. The links are indicated by a corresponding icon. A connection to the provider is only established if you click the provider’s icon. This means that data is not automatically transmitted to social media services when you visit our website.

5 RETENTION PERIOD
Data shall only be stored for as long as is necessary to fulfil the relevant purpose. Unless legal retention obligations or our own overriding interests prevent us from doing so, we delete data that is no longer required.
6 DATA SECURITY
KLOTZ Immobilien | Bau GmbH uses suitable technical and organisational security measures to protect the personal data stored against manipulation, partial or complete loss and unauthorised access by third parties. The security measures are continually improved in line with technological developments.
7 DATA TRANSFER
We may share your data with third parties if we offer a service in cooperation with a third party.
In order to combat fraud and abuse or in the event of any other suspected criminal activities, we may disclosure information to domestic and foreign law enforcement authorities and courts.
If we make any advance payments, for example in the case of a purchase on account, we reserve the right to obtain credit information from a credit agency in order to safeguard our legitimate interests in concluding a contract with solvent customers. To this end, we shall send the personal data required for a credit check to a credit agency and use the information obtained about the statistical probability of a default in payment to decide whether to establish, execute or terminate the contractual relationship. Your data shall not be transmitted to third parties for any other reason unless this is necessary to process a contract that you have concluded with us or you have expressly consented to such transmission.
We work with external service providers within the scope of fulfilling our contractual obligations and the specified purposes (in particular the publication of advertisements, the management of communities of condominium owners, data hosting or for land register documents).
We select our service providers carefully and ensure that these only process data in the manner in which we ourselves would be authorised to do so. They are also obliged not to process the data for their own purposes or to share it with unauthorised third parties.
Please note that our service providers may process your data both in the EU/EEA and in other countries that do not have an appropriate level of data protection. If we use providers in countries with a low level of security, the transmission is particularly based on Art. 17, para. 1, letter a DSG (consent) and Art. 16, para. 2, letter d DSG, with us contractually ensuring (e.g. through standard contractual clauses) that the protection of your personal data corresponds to that in Switzerland.
8 RIGHTS OF THE DATA SUBJECT
Within the scope of the applicable legal provisions, you have the right, at any time, to free information about the personal data stored about you, its origin and the purpose of the data processing. Where applicable, you also have the right to the rectification, restriction or erasure of this data and, if applicable, to the issuance or transmission of the data. You are furthermore entitled to object to the use of the data for marketing purposes and to revoke any previously granted consent to data processing. These rights apply providing the fulfilment of your request is not prevented by legal retention obligations or other overriding interests.
